We have been acting for Davidsons Developments Limited in relation to their Bardon Grange development in Hugglescote, Leicester. The scheme is for 800 dwellings, a local centre, primary school and country park.
We have also advised the former owners and option holders on keeping the historic planning permission alive and overseeing the sale of the site. We have represented Davidsons on their Section 73 application to obtain a revised planning permission significantly amending conditions and dealing with the associated Section 106 and 278 agreements.
The new planning permission was required to make the scheme financially viable. Had the permission not been granted the development might not have progressed.
We recognised, for the benefit of the former owners and the option holder, how to keep the planning permission alive, and how, therefore, to retain the sites value and how to improve value by varying the extant permission through the subsequent grant of the section 73 permission.
