This north east based building society was being sued by a firm of solicitors following a recent re-branding exercise.
The case involves registered trade mark infringement and passing off.
The case was important because the claimant was attempting to gain a monopoly in the marketplace over the use of a very common word and if they succeed then this would lead to a significant re-branding exercise for our client.
Following a confidential mediation, the parties settled the case just after witness statements were exchanged.
