Our deep knowledge of financial structures means we never shy away from what can be done, whether that’s ring-fencing non-marital wealth or freezing offshore assets.

To help you pay for the financial clean break you need, our financial settlement lawyers can tell you about any suitable third-party funding arrangements.

We can guide you through the division of assets and help you to achieve a successful settlement that works for you and everyone involved.  Call our divorce financial settlement solicitors now on 0330 024 0333 or contact us online and we can reach out to you.

Divorce financial settlement frequently asked questions

A settlement can be negotiated between the parties, with the assistance of their solicitors, without the need to go to court. It is advisable to have it formalised via a financial order so that it severs financial ties between the two parties.

Money and financial assets are taken into account when negotiating a financial settlement.  The aim is to divide the assets fairly and there is a common misconception that this is 50/50 – but this is a good starting point.  What is considered fair will differ from case to case but elements such as income, housing needs and children will be taken into consideration.

Matrimonial assets that are built up during the course of the marriage such as property savings, pensions, personal belongings and contents of bank accounts.

Non-marital assets  (those acquired prior to a marriage) are considered and are not necessarily excluded from a financial settlement.  For example, if savings were used to buy a marital home then the savings would become matrimonial assets.

If it is not possible to come to an agreement with your former partner/spouse, then a financial remedy application can be made – this is where the court decides upon an appropriate settlement for both parties.  You and your ex partner will need to attend court.

A financial settlement is a legally binding decision on how you and your partner will divide your assets and wealth when your marriage or civil partnership ends. This can include everything from trusts, pensions and property portfolios, to shares, bitcoin and international assets.

With so much to consider, you need the best legal expertise, combined with a forensic approach to finances, on your side. Our technically-astute financial settlement lawyers have decades of know-how to reveal the true position of assets and income. They also bring a new perspective and energy to seemingly intractable disputes.
