Our IP litigation team has successfully represented Norcros Group (Holdings) Limited (Triton) in defending a long-running patent infringement action brought by Kohler Mira.

In its judgment dated 22 December 2025, the Court of Appeal unanimously overturned the lower court’s findings of both validity and infringement of the patent in suit, which concerned Triton’s DuElec® range of dual outlet electric shower products.

The appeal was heard on 16 December 2025, and the Court of Appeal held that:

  • The patent was invalid for insufficiency, as the claims were found to be too uncertain, as their boundaries of what would or would not infringe were impossible to determine; and
  • Even had the patent been found to have been valid, the Triton products did not infringe the claims on normal interpretation or on the basis of ‘equivalents’.

The result therefore represents a comprehensive victory for Triton in these proceedings, and it remains free to sell its successful and popular DuElec® range of products.
