Our IP litigation team has successfully represented Norcros Group (Holdings) Limited (Triton) in defending a long-running patent infringement action brought by Kohler Mira.
In its judgment dated 22 December 2025, the Court of Appeal unanimously overturned the lower court’s findings of both validity and infringement of the patent in suit, which concerned Triton’s DuElec® range of dual outlet electric shower products.
The appeal was heard on 16 December 2025, and the Court of Appeal held that:
- The patent was invalid for insufficiency, as the claims were found to be too uncertain, as their boundaries of what would or would not infringe were impossible to determine; and
- Even had the patent been found to have been valid, the Triton products did not infringe the claims on normal interpretation or on the basis of ‘equivalents’.
The result therefore represents a comprehensive victory for Triton in these proceedings, and it remains free to sell its successful and popular DuElec® range of products.
Triton was represented by a team of Nicholas Briggs, partner, Daniel Kelly, legal director, Samuel Ellis and Shanice Spencer, both solicitors, within our IP litigation team, instructing Brian Nicholson KC and David Ivison from 11 South Square Chambers as counsel.
Nicholas Briggs, head of intellectual property, commented: “This is a great result most importantly for our client Triton. Their determination to pursue the appeal for what both they and we thought all along was the right result has been fully justified.”
Phil Viner, Managing Director of Triton, added: “Over recent years, we have been working towards resolving a legal dispute concerning the DuElec® electric shower. During this time, our legal team has vigorously defended Triton’s position, which has led the Court of Appeal to rule in Triton’s favour. We are therefore pleased to confirm that Triton will continue to sell the range of DuElec® electric showers in the UK and Ireland, as it has done successfully since the product was launched in May 2022.
We would like to extend our thanks to Shakespeare Martineau, and our wider legal team, for helping us to secure this comprehensive successful outcome.”
