Refuse workers refuse deal

We were instructed by Birmingham City Council to defend proceedings brought against it by Unite the Union on behalf of the city’s refuse workers. This case due to its complexity involved most of our employment team at some point. 

The dispute centred initially on proposed redundancies with Unite successfully obtaining an injunction against the Council. The claim was then focussed on a purported deal that was reached between the parties and whether there was the requisite authority in place for this deal to be reached. We had to prepare for an expedited trial in less than ten weeks.

Although the issues appeared relatively straightforward, it involved us undertaking a large scale electronic disclosure exercise in less than two weeks with hundreds of thousands of documents being reviewed.

We were eventually able to settle the matter successfully two days before the High Court trial.
