We advised the client in defending a claim brought by a previous employee for unauthorised deduction of wages and breach of contract.
The team represented the client throughout the litigation process and at the final substantive one-day hearing. This involved complex construction of a contractual clause and some policy documents. The claimant was also legally represented.
Despite the claimant’s claim being dismissed in its entirety in April 2018, the claimant appealed the judgement to the Employment Appeal Tribunal.
The Employment Appeal Tribunal subsequently dismissed the appeal again in October 2018 on the grounds that it had no reasonable prospects of success.
