On 1 January next year, a UK version of the GDPR will replace the current general data protection regulation. The UK will become a “third country” for the purposes of cross-border transfers of personal data from the European Economic Area. On top of this, the effectiveness of the safeguards provided by the Standard Contractual Clauses, which have up to now been the way most UK businesses have ensured transfers of personal data to the US and elsewhere were lawful, has recently been cast into doubt by the European Court’s Schrems II decision.
